Tiernan v. Charleston Area Medical Center, Inc.
West Virginia Supreme Court of Appeals
506 S.E.2d 578 (1998)
- Written by Sharon Feldman, JD
Facts
Betty Tiernan (plaintiff) was employed by Charleston Area Medical Center (CAMC) (defendant). CAMC terminated Tiernan’s employment. Tiernan was hired as a per diem at-will employee at Arthur B. Hodges Center, Inc. (ABHC), a nursing home affiliated with CAMC. When CAMC learned that Tiernan was working for ABHC, CAMC informed ABHC that Tiernan was working as a union organizer. ABHC stopped giving work to Tiernan. Tiernan sued CAMC, alleging that CAMC tortiously interfered with her business relationship with ABHC. The circuit court granted summary judgment to CAMC on Tiernan’s claim for tortious interference with a business relationship. Tiernan appealed.
