Facts
Tijani (defendant) was convicted of a crime in California and ordered to pay $28,000 in restitution. The Bureau of Immigration and Customs Enforcement (BICE) found that his conviction was an aggravated felony and found him deportable as a result. The immigration judge and Board of Immigration Appeals affirmed the Bureau’s determination. Tijani appealed the decision. The government detained him during this removal process for more than 30 months. Tijani petitioned for a writ of habeas corpus while waiting for a final ruling on his status. The district court denied his petition and he appealed to the Court of Appeals for the Ninth Circuit.
