Facts
Sea World Parks & Entertainment, Inc. (defendant) kept five orca whales, Tilikum, Katina, Corky, Kasatka, and Ulises (whales) (plaintiffs), at its amusement park. An organization called the Ethical Treatment of Animals, Inc. (the organization) filed a complaint for declaratory and injunctive relief as next friends of the whales. Specifically, the complaint alleged that the orca whales were being held in slavery and involuntary servitude, in violation of the Thirteenth Amendment of the United States Constitution. Sea World moved to dismiss the complaint pursuant to Federal Rules of Civil Procedure 12(b)(1) and 12(b)(6). The next friends opposed the motion.
