Facts
Gary Schmidt (defendant) used the services of Time-Share Systems, Inc. (plaintiff) to manage his business accounts and inventory. After a year, Schmidt terminated the agreement and Time-Share demanded that Schmidt return software Time-Share had created for Schmidt. Time-Share sued and asked the court to order Schmidt to return the software. The court granted Time-Share’s order, but Schmidt failed to return the software and later deleted it. The court found Schmidt in civil contempt and ordered him to pay Time-Share costs, attorney’s fees, and $2,500 in damages. Schmidt appealed.
