Facts
Tire Engineering and Distribution, LLC (Alpha) (plaintiff), a domestic producer of mining tires, sued Al Dobowi and Shandong Linglong Rubber Co., Ltd. (defendants), foreign corporations, for infringement. Alpha alleged that Al Dobowi and Linglong conspired to steal its tire blueprints, produced infringing tires, and sold those tires to former customers of Alpha. According to Alpha’s complaint, Al Dobowi obtained the blueprints from a former employee of Alpha and sent copies to Linglong in China, who manufactured infringing tires from the blueprints. The district court found Al Dobowi and Linglong liable to Alpha under the Copyright Act. Both Al Dobowi and Linglong appealed the decision, arguing that the Copyright Act has no extraterritorial reach.
