Facts
Radio personality Gary Meier (defendant) hired an entertainment law firm, Todd W. Musburger, Ltd. (Musburger) (plaintiff) to negotiate and draft employment agreements on a contingency basis. Musburger’s work on Meier’s behalf included the successful negotiation of a 10-year renewal contract with a radio station. However, Meier refused to pay Musburger for these services. Musburger brought suit for breach of contract, quantum meruit, and unjust enrichment. The trial court dismissed the breach-of-contract and unjust-enrichment claims but found in favor of Musburger on the quantum meruit claim. Meier appealed, arguing that Musburger acted as an unlicensed employment agency in violation of the Employment Agency Act. The Illinois Appellate Court granted certiorari.
