Facts
Dolan, an employee of a meat packing company, owed Topolewski (defendant) some money. As payment, Dolan proposed that Topolewski load barrels of meat onto his wagon and drive away as if he were a customer. After informing the company’s representatives of the plan and receiving their instructions to feign cooperation, Dolan carried out his end of the plan. Topolewski took the barrels of meat and was arrested, charged, and convicted of larceny.
