Facts
Belen Torres (plaintiff) brought an employment discrimination suit against the County of Oakland and Oakland Community Mental Health Services Board (defendants) based on a federal statute that stated that employers may not “discriminate against any individual . . . because of such individual’s . . . national origin.” At trial, the defendants called Dr. Quiroga, an employee of the defendants who was involved in the hiring process for a promotion for which Torres was passed over. Dr. Quiroga was asked the following question: “It is true, Dr. Quiroga, that you did not believe that Ms. Torres had been discriminated against because of her national origin in that interview process?” Dr. Quiroga responded in the affirmative, over Torres’s objection. The jury found in favor of the defendants. Torres appealed.
