Facts
Toscano (plaintiff) filed suit against the Senior PGA Tour (Tour) (defendant), claiming the Tour’s eligibility rules violated antitrust laws. The rules in question included a player-per-tournament limit and the ability of the Tour to select players on the basis of fan interest, rather than purely golfing ability. The Tour’s marquee players were those who gained fame on the PGA Tour and subsequently joined the Tour after reaching the age of 50. Toscano claimed selecting players in this fashion was anticompetitive. The Tour filed a motion for summary judgment.
