Facts
Trade Arbed, Inc. (Arbed) (plaintiff) entered into an agreement with Robert B. Miller & Associates (Miller), David Hammond, and Coastal Cargo Company (Coastal) (defendants) to settle a federal district court case. Subsequently, the court issued an order dismissing the case without prejudice to the right to reopen the case within 60 days if the settlement was not completed. Arbed alleged that the agreement provided that Miller, Hammond, and Coastal would each pay $2,000 to Arbed. After the 60-day period had expired, Arbed alleged that it had received the settlement funds from Miller but not from Hammond or Coastal. Arbed filed a motion to enforce the settlement agreement or, alternatively, a motion requesting that the court place the matter back on the court’s docket to proceed to trial.
