Facts
Caroline Trautwein and others (the chapter members) (plaintiffs) formed a new chapter of the fraternity the Order of the Eastern Star. The chapter members consisted of both new members and transfer members. The new chapter was formed under a temporary dispensation, but the statewide governing body for the Order then rejected the motion to grant the new chapter. This had the effect of severing the chapter and rejecting all of the chapter members from the Order. The chapter members sued officials of the Order including Clifford Harbourt (defendants) for willfully and maliciously preventing the new chapter from obtaining a charter, casting the members out of the Order, and destroying the members’ reputations. The Order officials filed a motion for summary judgment. The trial court granted the motion.
