Facts
Bailey (defendant) submitted an application to an agent of Travelers Insurance Co. (Travelers) (plaintiff) for a life insurance policy. The application requested a plan insuring the Bailey’s life for $5000, with a $500 per year annuity beginning at age 65 and continuing for at least ten years for the balance of his life. Travelers, however, inserted incorrect information into the policy form, yielding a policy with an annuity payment of $500 per month for life for at least one hundred months. Travelers brought suit to reform the insurance contract to the terms requested by Bailey. The trial court ruled for Travelers and Bailey appealed.
