Facts
A group of individuals (the individuals) (plaintiffs) sued Safeway Stores, Inc. (Safeway), multiple unions, and federal officials (defendants) for violation of Executive Order 11246, as amended by Executive Order 11375, which required government contractors to adhere to certain nondiscrimination and affirmative-action requirements. The individuals claimed that Safeway was a government contractor and that it discriminated against minorities and women and failed to implement an affirmative-action program. Safeway contended that the individuals were not entitled to bring a private cause of action under the executive orders and filed a motion for summary judgment on that basis.
