Facts
The government convicted Triangle Candy Co. (plaintiff) under the Food, Drug, and Cosmetic Act for selling adulterated food. Triangle appealed, arguing that it could not be convicted under the act because the government’s chief chemist failed to give Triangle requested samples of the food the government had tested and found adulterated.
