Facts
Tripp (plaintiff) enjoyed exclusive rights to provided ferry service from Kingston to Barton. Tripp provided ferry service only to Barton. Frank (defendant) provided ferry service to persons traveling from Kingston to Hull to Barrow. Barrow was on the coast two miles south of Barton. Tripp filed suit against Frank for infringing on his exclusive service rights. A verdict was entered for Tripp for one shilling. Frank appealed.
