In 2025, President Donald Trump (defendant) issued an executive order (the order) that purported to set forth a government policy restricting birthright citizenship for certain individuals born in the United States. A group of pregnant women whose children would not be citizens under the order, two immigrants’-rights organizations, and several states (collectively, the challengers) (plaintiffs) filed three separate actions to enjoin enforcement of the order. The challengers claimed that the order violated the Citizenship Clause of the Fourteenth Amendment and the Nationality Act of 1940. The three federal district courts where the challengers filed their respective suits concluded that the order was likely unlawful and issued universal preliminary injunctions preventing the order’s application to anyone in the United States. The three corresponding appellate courts denied the government’s requests to stay the injunctions. The government asked the United States Supreme Court to partially stay the injunctions and limit the injunctive relief to only the parties in the actions. In considering the government’s request, the Supreme Court analyzed whether the government was likely to succeed on the merits of its arguments regarding the scope of the relief granted by the district courts.
