Trump v. Thompson
United States Supreme Court
142 S.Ct. 680 (2022)
- Written by Tiffany Hester, JD
Facts
[Information not contained in court’s opinion.] [Editor’s Note: The casebook explains that after former-president Donald Trump’s term ended, Trump tried to assert executive privilege over communications that occurred while he was in office regarding the January 6, 2021, insurrection at the United States Capitol building. The current president at the time, President Joe Biden, waived the privilege. This action by Biden raised a question about whether a former United States president can assert executive privilege over communications that occurred while that president was in office despite the current president’s waiver. The lower courts held against Trump without resolving that question.]
