Facts
Macquarie Infrastructure Management (Macquarie) (defendant) invited the public to invest in the construction of a toll road. Truth About Motorways (plaintiff) brought suit, arguing that the information Macquarie published about the volume of traffic on the road was misleading. Macquarie argued that Truth About Motorways did not have standing to bring the suit because Truth About Motorways had not suffered any injury and thus had no direct or special interest in the proceedings.
