Facts
Tubbs (plaintiff) was riding in a car owned and operated by Argus (defendant). Argus crashed, causing injury to Tubbs. Argus left the scene of the accident without offering aid and assistance to Tubbs. Tubbs filed suit against Argus for negligence. Argus moved for demurrer of Tubbs’s complaint. The trial court sustained Argus’s motion and entered judgment in his favor. Tubbs appealed to the Indiana Court of Appeals.
