Facts
Ty Inc. (plaintiff) was a Delaware corporation headquartered in Illinois. Ty held multiple trademarks for plush toys, including Beanie Babies and beanies, in Europe. After Ty obtained these trademarks, Joseph Parvin (defendant) registered the domain names ebeanies.com and e-beanies.com with Network Solutions, Inc., and ebeaniebabies.com and ebeaniebaby.com with CORE Internet Council of Registrars. However, Parvin did not use any of these domain names as active websites. According to Ty, Parvin offered these domain names for sale on a website called domains.com, without consent from Ty. Eventually, Ty applied for trademark registration with the United States Patent and Trademark Office.
