Facts
An Italian seller (plaintiff) contracted with a German buyer (defendant) for installment deliveries. The seller suspended one installment’s delivery without notifying the buyer. The buyer eventually obtained delivery only after paying the seller more than the contracted-for down payment. The seller sued the buyer in the German district court based in Frankfurt, demanding full contract payment. The buyer counterclaimed for damages.
