- Written by Rich Walter, JD
Facts
A German buyer (plaintiff) ordered a furnace from a Swiss seller (defendant). Upon delivery, the buyer declared the furnace defective in many respects. The buyer sued the seller for restitution of advance payments and damages. The court for the Swiss canton of the Jura validated only one of the claimed defects. The court found that this defect was easily remediable at only minor expense.
