Facts
A German buyer (defendant) ordered Italian-made tile from the operator of a German market stand. The Italian seller (plaintiff) invoiced the buyer for the tile. The market-stand operator collected payment from the buyer after agreeing to discount the invoiced price. This payment never reached the seller. The seller demanded full payment from the buyer. When the buyer did not respond to this request, the seller sued the buyer in the district court based in the German town of Alsfeld. The United Nations Convention on Contracts for the International Sale of Goods (CISG) applied to the case.
