Facts
United Investors Life Insurance Company (United) (plaintiff) sued Waddell & Reed, Inc. and others (Waddell) (defendants), alleging unfair competition claims. United claimed that Waddell had engaged in a nationwide campaign to induce United’s policyholders to switch to another insurance company. Waddell filed a demurrer, or a motion to dismiss, arguing that United did not have standing to sue under the relevant statutes. The trial court granted the demurrer, and United appealed. The defendants then filed a motion to dismiss the appeal.
