Facts
United Oil Company Inc. (United Oil) (plaintiff) sued Rohm & Hass (R&H) (defendant) for indemnification. United Oil, a chemical distributor, paid a products liability claim that allegedly arose as a result of exposure to chemicals produced by R&H. The products liability cause of action was based on a failure to warn of the chemicals’ propensity to cause liver disease. United Oil submitted discovery requests to R&H, seeking information concerning litigation or claims related to similar chemicals and products. R&H challenged those requests on the basis of relevancy.
