Facts
Emery Beaulieu (defendant) was charged with aggravated sexual abuse of a minor. The alleged victim, S.L., told her nurse and her psychologist that Beaulieu had sexually abused her. At trial, the prosecution (plaintiff) called the nurse and psychologist as witnesses. The district court permitted the nurse and psychologist to testify about S.L.’s statements to them under Federal Rule of Evidence 803(4) (Rule 803(4)), the medical-diagnosis exception to the hearsay rule. Beaulieu was convicted, and he appealed.
