Facts
While in Finland, a German commander (defendant) undertook a scorched-earth operation in enemy territory after mistakenly anticipating an attack by Russian soldiers. Ultimately, the Russians did not execute an attack; however, the area evidenced plans of attack, with visible foxholes and guns positioned in defense posts. The commander was charged with crimes related to the destruction. In defense of the crimes, the commander claimed that he acted in self-defense.
