Facts
The United States Environmental Protection Agency (EPA) (plaintiff) brought a civil-enforcement action against Environmental Waste Control, Inc. (EWC) (defendant). The EPA alleged that EWC violated the Resource Conservation and Recovery Act (RCRA) when EWC failed to obtain insurance coverage at its landfill. Following the trial, EWC lost its ability to operate the landfill. EWC argued that a government employee working at the EPA’s RCRA hotline provided EWC’s insurance agent with a coverage-limit requirement that was inadequate to meet the larger coverage limit the EPA later sought to enforce. EWC alleged that it relied on an inaccurate coverage limit provided by the EPA to its detriment. EWC argued that the doctrine of estoppel applied and that the EPA could not enforce the later interpretation of coverage limits. EWC asserted that it should not be penalized considering its good-faith efforts to comply with the RCRA insurance requirements.
