Facts
The North American Dredging Co. of Texas, an American corporation, entered a contract for dredging of a port with the Mexican government. The contract contained a Calvo clause, which was a waiver of the company’s rights to institute any actions other than those available to it under Mexican law. The United States brought an action to the tribunal on behalf of its company against the Mexican government. The Mexican government sought enforcement of the Calvo clause.
