Facts
After an inspection revealed that Argent Chemical Laboratories, Inc.’s (defendant) veterinary drugs violated the Food, Drug, and Cosmetic Act, federal agents secured an in rem arrest warrant to seize the drugs. The warrant was secured in accordance with the act, which allowed for warrant without the intervention of a judicial officer or a showing of probable cause as required under a normal warrant. After the drugs were seized, Argent contested the seizure as a violation of its Fourth Amendment rights. The court ruled in Argent’s favor, and the government appealed.
