Facts
The United States, alleging violations of the Food, Drug, and Cosmetic Act, sued for a preliminary injunction to stop Rx Depot, Inc. (defendant) from importing drugs from Canada and selling them to United States consumers. Rx Depot accepted prescriptions from United States consumers, had Canadian doctors rewrite the prescriptions, and then mailed the drugs to the consumers and charged their credit cards. The intent was to avoid high drug costs in America.
