United States Shoe Corporation (plaintiff) sold women’s pumps using the slogan “Looks Like a Pump, Feels Like a Sneaker.” Brown Group, Inc. (defendant) began selling a women’s pump using the slogan “Think Of It As A Sneaker With No Strings Attached.” The fine print of Brown’s advertisements stated: “And when we say it feels like a sneaker, we’re not just stringing you along.” U.S. Shoe sued Brown for trademark infringement.
