Facts
The United States sought to condemn and destroy as adulterated various egg products sold by Golden Egg Products, Inc. As proof that the products were filthy, putrid, or decomposed under the Food, Drug, and Cosmetic Act, the government presented evidence of a high living and dead bacteria count in samples of the product. Golden Egg challenged the use of this standard as evidence of actionable decomposition.
