Facts
The government sought to condemn canned American Beauty Brand Oysters for containing shell fragments that could be swallowed by consumers. The manufacturer of the oysters defended itself by arguing that it used the most modern devices to remove the shell fragments, that oysters were commonly understood to contain shells, and that shells could never be entirely removed from oysters. The government argued that it was the injurious character of the deleterious substance, not the quantity, that required the product to be condemned.
