Facts
The United States (plaintiff) brought a libel against seven barrels of dried eggs that it sought to condemn under the Food, Drug, and Cosmetic Act. The seller had intended to sell the eggs to the Federal Surplus Commodities Corporation and had set the barrels aside so they could be inspected and tested to make sure they met the government’s requirements. The egg seller defended itself by arguing that the federal government had no jurisdiction over the eggs because they had not yet entered interstate commerce. The court ruled in the seller’s favor, and the United States appealed.
