Facts
The United States sued to condemn 88 cases of Bireley’s Orange Beverage. The trial court found that the drink met the Food, Drug, and Cosmetic Act’s definition of unlawful adulteration and issued a condemnation decree. The owner of the drink appealed, arguing that the act’s definition of adulteration did not cover the processing of food and that the trial court failed to apply the act’s adulteration definition correctly.
