Facts
The United States sought to condemn shampoo as an adulterated substance because it contained deleterious substances that could cause injury to shampoo users. To prove that the shampoo was injurious, the United States provided evidence that temporary injury would occur to users who got the shampoo’s full strength concentrate in their eyes. The shampoo manufacturer countered that the typical use of the shampoo, namely while taking a shower, would make it very rare that the shampoo would enter a user’s eye in an undiluted form unless a user used the shampoo uncommonly close to his or her eyes.
