Facts
Misty Angell (defendant) was charged with mail theft and simple possession of amphetamine in federal district court. The government alleged that five grams of methamphetamine were found in Angell’s possession during prebooking for her arrest for mail theft. The arrest occurred seven days after Angell was seen stealing mail from mailboxes. At trial, Angell moved for the court to sever the two counts because they were improperly joined in the indictment and their joinder would prejudice her defense.
