Facts
The United States Coast Guard (Coast Guard) seized a Bolivian vessel in the Caribbean that was on its way to the Dominican Republic from Colombia. The Coast Guard discovered drugs on the vessel that were illegal in the United States. Alberto Angulo-Hernández, Eusebio Estupinan-Estupinan, and Gustavo Rafael Brito-Fernández (defendants) were on board at the time of the Coast Guard’s seizure of the vessel. The three men, none of whom were United States nationals, were convicted under the Maritime Drug Law Enforcement Act (MDLEA). The Court of Appeals for the First Circuit affirmed. Angulo-Hernández, Estupinan-Estupinan, and Brito-Fernández petitioned for rehearing with the panel of judges who heard the case and for rehearing en banc on the grounds that the MDLEA was inapplicable.
