Facts
The government sued Midwest Pharmaceuticals, Inc. (defendant) for a permanent injunction prohibiting it from selling or marketing any drugs. Midwest bought legal drugs in bulk and then repackaged them and ran advertisements in pornographic and biker magazines that implied the drugs were actually illegal and controlled substances. Midwest’s target consumers were unsophisticated middle- and high-school age children looking for street drugs. The district court granted the permanent injunction. Midwest appealed, arguing that the language of the injunction was not specific enough to be lawful.
