Facts
The Food and Drug Administration (FDA) sought to seize drugs in the possession of Foods Plus, Inc. (defendant). The FDA claimed the drugs were misbranded because of oral representations made by Carlton Fredericks, a nutritionist who appeared on radio programs and was under contract with Foods Plus. Specifically, although Fredericks claimed that the drugs were effective for various conditions, neither he nor any labeling (including a catalog that came with the drugs) described all of those conditions or prescribed adequate directions for use in treating those conditions.
