Facts
Atdilon Baez (defendant) was charged with knowingly possessing a semiautomatic firearm after having been convicted of a felony and of knowingly selling a semiautomatic firearm to a convicted felon. Before trial, Baez said that he planned to assert an entrapment defense. The United States (plaintiff) responded by seeking to introduce evidence that showed Baez’s predisposition to commit the charged crimes. The government’s evidence included Baez’s statements, conduct, and prior convictions for weapons possession. The district court admitted the government’s evidence over Baez’s objection. Baez was tried and convicted, and he appealed to the United States Court of Appeals for the Second Circuit.
