Facts
Maria Barona (defendant) was investigated for her role in an international cocaine-trafficking conspiracy. During the Drug Enforcement Administration’s investigation, American law enforcement officials requested wiretaps in Denmark. Denmark granted the requests, and the wiretaps were used to record both American citizens and foreign nationals. Based on the wiretap information, Barona and several other defendants were convicted of drug crimes. Barona appealed to the United States Court of Appeals for the Ninth Circuit, arguing that the Danish wiretaps violated her rights under the Fourth Amendment.
