Facts
Levangela Bedonie (defendant) pled guilty to involuntary manslaughter for the drunk-driving death of Brian Johnson. Redd Serawop (defendant) was convicted of manslaughter for his infant daughter Beyonce’s death. With respect to restitution to be awarded under the Mandatory Victims Restitution Act (MVRA), (1) Bedonie raised arguments that assumed Johnson’s estate was the victim; (2) Serawop argued that lost income could not be awarded in homicide cases; (3) Bedonie maintained that restitution could not include future lost income; and (4) all parties argued that consumption should be deducted from lost income. A court-appointed expert produced calculations of Johnson and Beyonce’s lost income relying on race and sex assumptions and others using race- and sex-neutral statistics. The court issued this memorandum opinion explaining its restitution awards.
