Facts
Captain Graham S. F. Belz (defendant) was convicted of conduct unbecoming an officer by committing misconduct related to drug abuse, pursuant to Article 133 of the Uniform Code of Military Justice (UCMJ). At Belz’s court-martial, the military judge excluded evidence of Belz’s good character as a military officer, reasoning that the evidence was not pertinent to charges involving drug-abuse offenses. The Court of Military Review affirmed Belz’s conviction, and Belz appealed.
