Facts
Donald Biggs (defendant) was indicted for sex offenses involving minors. Biggs’s trial was scheduled to begin on December 4, 2017. In mid-August 2017, Biggs’s attorney, who was appointed to represent Biggs on May 9 and was Biggs’s third appointed counsel, began engaging in plea negotiations with the attorneys for the government (plaintiff). Biggs and the government jointly moved to continue the deadlines for pretrial filings. At the end of October, the government attorneys made a plea offer that was subject to approval from a senior supervisor. On October 30, Biggs’s counsel was advised that the plea offer had not been approved. Biggs and the government jointly moved to extend the pretrial-filings deadline. Biggs also moved to continue the trial date for 90 days and to exclude the time under the Speedy Trial Act. The government opposed the motion to continue the trial date.
