Facts

Two United States citizens (defendants) allegedly bribed Canadian officials Donald Castle and Darrell Lowry (defendants). All four people were charged in federal district court with conspiring to violate the Foreign Corrupt Practices Act (FCPA). Castle and Lowry moved to dismiss the charges against them, arguing that because the FCPA does not penalize foreign officials who accept improper payments that are made in violation of the FCPA, Castle and Lowry could not be charged with conspiracy to violate the FCPA. Castle and Lowry also provided evidence that the Royal Canadian Mounted Police were actively investigating the same allegations and that Castle and Lowry would likely face charges in Canada.
