Facts
Mark Bozovich (defendant) was charged with conspiracy to distribute heroin. At trial, the defense called Bozovich as a witness. Bozovich testified that he was a heroin addict but was not involved in heroin distribution. Bozovich testified extensively about his heroin addiction and how it ruined his life financially and in other ways. On cross-examination of Bozovich, the prosecution (plaintiff) asked about statements Bozovich had made to agents of the Drug Enforcement Agency. In the statements, Bozovich had identified suppliers who gave him and his acquaintances heroin and identified how much heroin he generally bought. The district court allowed the questioning over Bozovich’s objection. Bozovich was convicted, and he appealed.
