Facts
Two defendants convicted of drug trafficking charges under a grand jury indictment appealed their convictions claiming that prosecutors for the United States (plaintiff) abused the grand jury process. In the case of Carhuapoma (defendant), the United States presented only hearsay evidence to the grand jury. Carhuapoma asked the court of appeals to exercise its supervisory powers to dismiss his indictment.
