Facts
Bronx Reptiles, Inc. (defendant) was convicted of importing improperly packed frogs into the United States from the Solomon Islands, violating a statute which criminalized “knowingly” transporting any wild animal or bird to the United States “under inhumane or unhealthful conditions.” Bronx Reptiles appealed, arguing that the government failed to prove that Bronx Reptiles knew that the conditions under which the animals were transported were inhumane or unhealthful, an element required by the statute.
